Terms

 

The Company     Lamont Stone

The Customer   The person or persons who have signed the order form.

The Contract     The contract between the Company and the Customer for the sale and purchase of the goods incorporating these conditions.

The Goods         The products detailed on the order form.

The Price           The total of all goods, services and taxes shown on the order form.

Delivery date     The date notified to the customer by the company subsequent to the order being placed.

1 Basis of Sale

All Contracts between the Company and the Customer shall be subject to these and only these terms and conditions of sale.

No variation, waiver or addition to these conditions shall be binding unless agreed in writing and signed by both the Company and the Customer.

 

2 Orders and specifications

2.1 It is the Customers responsibility to check that all details on the order are correct. The Customer will sign the order as acknowledgement of its accuracy.

2.2 The Goods supplied are natural materials and are subject to their natural markings, veins, variations in colour, shading, texture fissures and vents. They are supplied filled, resined, reinforced and and laquered where necessary. Such features should in no way be regarded as defects as they are part of the natural formation and do not reduce the quality of the Goods.

2.3 All samples provided serve only to indicate in a general way the colour, markings and texture found in each particular material. Descriptions and pictures etc, are for general guidance only and do not form part of the Order.

2.4 All thickness measurements quoted are estimates and actual thickness measurements are subject to reasonable variation.

2.5 Goods supplied on Orders subsequent to an original order for the same item may not match the original due to natural variations.

2.6 Goods may change appearance through normal wear and tear, natural maturing or humidity fluctuations.

3 The Price

3.1 The price of the Goods is the price stated in the Order. All Goods and services will be subject to VAT as applicable.

3.2 All prices quoted are valid for ninety days from date of estimate.

4 Terms of Payment

4.1 Unless the Customer has a certified ledger account in place with the Company, the Customer will pay the Company 100% of the purchase price prior to manufacture.
4.2
If the customer selects specific materials to be used for their job a £200.00 deposit is required. If the customer wishes to cancel this order it must be done within three working days from the order date otherwise this deposit is non refundable. This is to cover for the cost of material handling and restocking charges.

4.3 The Customer cannot request cancellation of the Order unless they pay the losses and costs suffered by the Company as a result of cancellation.

4.4 No payment shall be deemed to have been received, until the Company has received cleared funds. The Customer shall not be entitled to withhold payment for any reason.

4.5 The Company reserve the right to charge interest of 1.5% per month on overdue accounts exceeding the agreed payment terms (whether before or after any judgement)

4.6 The Company reserves the right not to deliver the Goods in the event of non payment of the Price.

5 Delivery / Installation

5.1  Every effort will be made to keep delivery dates but no liability will be accepted for loss through delay for reasons beyond the companies control or, by industrial disputes of any kind. The Customer acknowledges the delivery / install may be subject to delay caused by matters beyond the control of the Company including but not limited to supply of materials, unexpected levels of demand, manufacturing problems, inclement weather, traffic strike, riot and civil commotion, etc   

5.2   The Company shall not be responsible for any consequential including but not limited to :- Loss of earnings or other loss of income or revenue in the event of delay of delivery or fitting.

5.3  The Company is not obliged to pay compensation for distress of inconvenience howsoever caused.

5.4  It is the Customers responsibility to provide reasonable safe proximate access to the premises for the delivery or installation.                                                                                                         

5.5 The Customer must notify the Company of any features in any room where the goods are to be fitted which might make installation unexpectedly difficult, such as unsound walls or floors or floors that are known to be out of true.

5.6  The Customer acknowledges that the Company does not carry out work to electrical, gas, water or other utility supply equipment.                                                                                                          

5.7 The Customer agrees that the Company cannot give a flush finish to stipple, artexed, stone cladded or other uneven wall finishes. Whilst all reasonable expertise will be used it is not possible to guarantee a flush finish to uneven surfaces.                                 

5.8 To ensure that prior to the expected day of fitting that you have carried out at no expense to the Company any necessary removal, re-routing or refitting of any utility supply equipment including any pipes, wires, cables or meters in such a manner as complies with all regulations or requirements of the relevant utility supplier.                                                                                                                                              

5.9 The Customer agrees not to hold the Company responsible for scuffs or scratches to walls, floors or ceilings which might have occurred despite reasonable care being taken during delivery and / or installation. The Customer accepts that floors are vulnerable to scratching and it is the responsibility of the Customer to protect these prior to delivery / installation with a suitable covering. The Customer accepts that re-decoration should not take place until after installation of all goods.

6 Risk and Property                                                           

6.0 The Customer is to ensure that access to the room within a property where goods are to be delivered and / or fitted is clear and not impeded by furniture, electrical goods, child gates, or other obstacles. The Company is not obliged to remove doors furniture or other obstacles.                                                           

6.1 The Customer is to ensure that any dogs or other pets are securely restrained at all times during delivery / or fitting away from any rooms to which the goods are to be delivered and / or installed                                                                                                                                                                                               
6.2 The Customer is responsible for any loss or damage to the Goods once the Goods have been delivered or installed to the Customer.

6.3 The Company retains the ownership of the Goods until the Company has received full payment of the Price.

 

7 Warranties and Liabilities

7.1 The company shall be under no liability in respect of any defect in the goods arising from any drawing, design specification or template supplied by or on behalf of the customer.

7.2  Important Notice : Time limit for further notification of claims. The customer will inspect the goods following delivery or installation, and any shortages or damages to the goods or any other claim must be notified to the company in writing within 7 days of delivery or installation, or by e-mail at mail@lamontstone.com failing which the company shall not be under any obligation to rectify damages unless a time extension is requested by you and agreed by us in writing.

7.3 Where any valid claim in respect of the goods which is based on any defect in the quality or condition of the Goods or their failure to match their description is notified to the company in accordance with these conditions. The company shall be entitled to replace the goods (or the part in question) free of charge or, at the discretion of the company refund the customer the price of the goods (or a proportionate part of the price) but the company shall have no further liability to the customer.

7.4 The companies liability arising from any loss or damage in connection with the manufacture, sale, installation, delivery, or use of any Goods sold by the company shall in all cases be limited to the cost of replacement or repair of the relevant goods and under no circumstances shall the company be liable for any other damage or expense occasioned by any breech of contract, negligence, or breech of duty whatsoever and whosoever.
